La eficiencia en el sistema penal español: con especial referencia al modelo de conformidades

The present work describes the way in which some efficient logics have been positioned Spanish penal system. With this objective, a systematic review of political-criminal literature on matter has carried out. Likewise, instructions Attorney General’s Office, various reports New Judicial Office (NOJ), judicial statistics and preliminary draft criminal procedure codes (2011, 2012 2020), among other pertinent information, examined. In we determine three areas to observe phenomenon. 1) respective literature; 2) attempt implement an “organic managerialism” manifested so-called Office; 3) justice system negotiated Spain, especially plea bargaining model. We conclude that: a) Despite few studies management / efficiency its penetration is undoubted. Certainly different from contexts (Anglo-American Latin-American); b) consolidation model accelerationist features configured not only by legal factors, but also socio-economic, technological criminological elements; c) Its main manifestation observed rapid procedures (way ending litigation 70% ordinary cases 90% trials); d) attempts transform entire organizational dimension materialized.
